Divorce Requirements in Virginia

If you wish to file for divorce in Virginia, you must have been a resident for a minimum of six months prior to filing. You must also have acceptable grounds for your divorce. Since Virginia is a hybrid divorce state, the court will accept either no-fault or fault grounds.

No-Fault Divorce

The only requirement for no-fault divorce is that the spouses have continually lived apart for at least one year. Those who do not meet this stipulation will need to request a divorce based on a spouse’s marital misconduct.

The permissible fault grounds for divorce include:

  • Either spouse committed adultery, sodomy, or buggery
  • One spouse has a reasonable fear of bodily harm based on the other spouse’s cruelty
  • One spouse has willfully deserted or abandoned the other spouse for at least one year
  • Either spouse has been convicted of a felony

Contested Vs. Uncontested Divorce

There are two types of divorces: contested and uncontested. When spouses cannot agree on getting a divorce or the terms of the divorce, the divorce is considered contested. An uncontested divorce is one in which both spouses want to divorce and have reached an agreement on all divorce-related matters.

This route is preferable due to the simplicity and shorter duration of the process, yet it is not always possible.
