If you wish to file for divorce in Virginia, you must have been a resident for a minimum of six months prior to filing. You must also have acceptable grounds for your divorce. Since Virginia is a hybrid divorce state, the court will accept either no-fault or fault grounds.
The only requirement for no-fault divorce is that the spouses have continually lived apart for at least one year. Those who do not meet this stipulation will need to request a divorce based on a spouse’s marital misconduct.
